• To assist in the execution of FTA’s financial policy manual, systems, and procedures, supporting key functions, including the timely and accurate processing of financial and accounting data. Duties and Responsibilities:

Financial Management

• Ensure accurate and timely posting of data into the accounting system e.g. receipts, bills, fund requests, payments, and Journals.

• Act as banking agent for all ECAN bank accounts.

Requisitions and Procurement

• Prepare requisitions for procurement of office assets and other office running costs for all ECAN offices.
• Monitor and procure kitchen supplies as needed for all ECAN offices.

Administrative Support

• Supervise office cleanliness, and coordinate office equipment repair and maintenance
• Coordinate Operation Team’s Logistics.
• Ensuring timely payment of utility bills (water, electricity, internet)
• Maintain an accurate filing system for finance transactions
• Coordinating projects accounting including filing of timesheets and project documents and correspondences.
• Issue Travel Insurance for the team.

• Develop and implement sales enablement strategies to support the increase of Fairtrade uptake and sales. This includes international and regional markets.

• To ensure that donor funds are utilized for the intended projects and programmes within FTA and external partners. To process transactions and maintain financial and accounting records in accordance with donor requirements.

KEY DUTIES AND RESPONSIBILITIES:
Grants & Partner Management

• Ensure departments comply with all donor rules, regulations, and award conditions to ensure funds are used for the intended purpose.
• Monitor deposits & money transfers and maintain balances to ensure project needs are met.
• Ensure all costs related to the grant are charged to avoid overspending and underspending within projects.
• Monitor budget spends and account for any variances.
• Participate in grant proposal development and extensions and provide technical support in development of grant budgets
• Monitor financial performance for grants and produce reports according to donor reporting requirements
• Manage preparation, consolidation and distribution of timely monthly, quarterly and annual financial statements reflecting status of projects and or programs based on donor requirements

Financial Management

• Post and review all expenditures and transactions in Oracle, according to programme and projects budgets and FTA’s internal financial procedures

ASSIGNMENT BACKGROUND

Fairtrade Africa is embarking on operationalizing its 2021-2025 strategic plan. One strategic pillar of this strategy is product and market development which includes building the Fairtrade brand in Africa.

Fairtrade-certified products can be identified through Fairtrade Marks. Fairtrade Mark(s) are all individual trademarks and certification marks worldwide that protect the original design of the black core logo which are owned by Fairtrade International. The Fairtrade Mark(s) may be used under a respective license agreement on consumer-ready products, including Packaging and Promotional Material, for the following use scenarios, namely:

1. Single-ingredient and composite (multiple ingredient) food products where every ingredient is certified under the Fairtrade Standards (e.g. a coffee pack);
2. Composite food products containing both certified and non-certified ingredients (e.g. a chocolate bar);
3. Non-food composite products containing both certified and non-certified components (e.g. cosmetics, cotton and gold etc);

Legal Advisory services

• Provide legal protection advise to management
• Review and provide advice on all documentation that require legal input (donor and other contracts, tender documents etc.)
• Provide and interpret legal information, conduct training, and disseminate appropriate legal requirements to staff.
• Interacts with management to advise on all aspects of legal implications specific to projects or programs addressing general matters pertaining to Intellectual Property (IP) and to guide the organisation on the application of IP laws and principles alongside the organization’s own policies.
• Ensuring organizational information and knowledge is copyrighted and protected and ensuring enforcing copyrights
• Keep track of new updates in relevant legal provisions and provide advice and follow- up with management actions accordingly

Legal support

• Protect FTA’s interests by vetting all contracts with third parties.
• Advise users on the legal issues in respect to proposed contractual arrangements / Memorandum of Understandings / Mutual confidential agreements
• Assess agreements and partnerships deeds for minimizing/eradicating risks and exposure
• Assess ongoing cases and execute the best course of action

Liaison with User Departments

• Develop effective working relationships with key users’ units to ensure their needs are understood and appropriate solutions developed to support business needs.
• Assist in drafting different types of legal documents
• Review, negotiate and draft commercial agreements involving all functional areas of the organization from routine agreements to major transactions
• Prepare Board Reports on all completed Contracts that need to be brought to the attention of the board
• Manage litigation briefs to protect FTAs interests and reduce its exposure.

Litigation Management

• Follow up on litigation cases where FTA is a Plaintiff to ensure that damages due to FTA are recovered.
• Keep an up-to-date schedule of legal costs incurred, compiling list of claims and status with a view of establishing impact costs
• Receive court summons and liaise with external lawyers
• Advise the organization and related entities on the litigation risks of possible business decisions, providing preventive counseling with respect to the legal risks associated with business practices; and developing strategy with both inside and outside counsel in response to civil litigation and regulatory inquiries
• Review progress of outstanding litigations and liaise with external lawyers

Statutory Compliance

• Must be a member of the Law Society of Kenya with a current practicing certificate.
• An advocate of the High Court of Kenya.
• CPS (K) and membership of the ICPSK will be an added advantage.

Experience and Knowledge

• Should have at least Four (4) years relevant work experience.
• Some experience working in an international NGO with a strong understanding of the humanitarian operating models and development programs / approaches in both regular and relief situations.
